This policy covers how Elite Construction Solutions, LLC (“ECS”) collects, uses and protects the information it gathers through your use of the Software. All capitalized terms contained herein have the same meaning as defined in the Terms of Use and End User License Agreement. (link)

Your Information.

Through your use of the Software, you will submit information to ECS including (but not limited to):

General registration information – such as your name, email address, account or credit card numbers;
Names of your employees, independent contractors and subcontractors;
Prices at which you sell or plan to sell certain construction services;
Your material suppliers;
Prices at which you purchase construction material;
Types and quantity of construction material you order and plan to order;
Compensation you pay to your employees, independent contractors and subcontractors;
Names and addresses of your customers;
Construction services, equipment and material you provide or will provide to each customer.

Location Information. When you use the mobile version of the Software, ECS may access your device's location services to collect your current geocoordinates. This location data is used temporarily to show you your closest customers and to automatically populate your current address when creating new leads. Your location information is not stored by ECS and is only used in real-time to provide these location-based features.

ECS is fully committed to protecting the privacy of your information.

ECS’s Protection of your Information.

Except as expressly provided herein or required by law, ECS will keep your information completely confidential and will not knowingly, in any manner disclose, divulge, communicate, transfer or otherwise make available your information to any third party. ECS will not sell, trade or otherwise transfer to third parties any identifiable information. This does not include trusted third parties who assist ECS in operating the Software or servicing you, so long as those parties agree to keep your information confidential.

ECS’s Use of your Information.

ECS may use your information in the following ways:

To provide the Services;
To help ECS better respond to your individual needs;
To improve the Software and Services;
To improve customer service;
To process transactions;
To communicate with you;
To aggregate Non-identifiable Information (as defined below) to identify general customer trends;
To display your closest customers based on your current location (mobile only);
To automatically populate address fields when creating leads using your current location (mobile only);
To comply with legal requirements.

ECS’s Use of Non-Identifiable Information.

“Non-Identifiable Information” is information that is recorded by ECS so that it no longer reflects or references individually identifiable users. ECS may use Non-Identifiable Information to aggregate data to understand general customer trends. ECS may sell, trade or otherwise transfer this Non-Identifiable Information to third parties. By your use of the Software and Services, you consent to ECS’s sale, trade or other transfer of Non-Identifiable Information. Non-Identifiable Information may include, for example, the types and quantity of construction equipment and material you purchase, which is then aggregated to show trends about the use of certain equipment and materials.

Cookies. ECS may use a technology called “cookies” to track patterns of behavior of users of the Software. You can usually modify your browser to prevent this from happening.

Third Party Sites. The Software contains links to third party websites. ECS is not responsible for the content or privacy practices of such non-ECS websites.

Change. This Privacy Policy may change from time to time. ECS will not reduce your rights under this Privacy Policy without your explicit consent. ECS will post any Privacy Policy changes on this page.
